How we can help

How We Help You

At SM Law Group, our job is to assist you with getting through these troubling financial times.

We offer debt relief solutions for people and small businesses throughout California. Our founding attorneys, John Sarai and Kian Mottahedeh, both were associates in larger law firms, where they gained a great deal of experience. We are now bringing this large firm experience to you on a personal level.

I Am Facing Foreclosure and/or Eviction

A Chapter 7 will delay a foreclosure, but only temporarily. The lender is unable to proceed with the foreclosure until it gets a court order from the bankruptcy court authorizing it to proceed, or until the bankruptcy case is closed. In a Chapter 13 you keep everything you own while you make payments on your debt. The payment is based on many factors, including your income, your assets, and the amount of your debt.

I Have Been Threatened With Wage Garnishments

If a creditor sues you, and obtains a judgment, they are entitled to garnish up to 25% of your wages per paycheck, levy your bank accounts, and/or place liens against your assets. A bankruptcy filing will prevent creditors from doing so if filed before the judgment, and will stop creditors from continuing any further if the bankruptcy is filed after the judgment.

I Have Too Much Credit Card Debt

Most kinds of debt can be permanently wiped out in a Chapter 7, such as credit cards, medical bills, and personal loans. There are other categories of debt that can not be wiped out in a bankruptcy. These kinds of debt include most taxes, student loans, child support/alimony, and debt incurred through fraud. If you do not qualify for a Chapter 7, a Chapter 13 will allow you to reorganize on your debt and pay back only what you can afford, based on your monthly income.

I Am Constantly Being Harassed By Creditors

If you are being constantly bothered by creditors or collections agencies, you can immediately begin telling them to call us. Once told to call us, they may no longer contact you. As soon as you hire us, you can begin referring the calls to us directly. In addition, your Federal and State governments protect you, the consumer, against abusive and harassing collection attempts by creditors and collection agencies. The law regulating how a debt may be collected from you is called the Fair Debt Collection Practices Act (FDCPA). If a creditor or collector violates the law, you are entitled to sue them in State or Federal court. You are entitled to compensation for damages caused by the collector, $1,000.00 in statutory damages, court costs and attorney’s fees.
