Can Bankruptcy Clear Tax Debts?

Bankruptcy can discharge tax debts if the following conditions are met:
- Only income taxes can be discharged. If you have other taxes - payroll, penalties, etc. - these taxes cannot be erased in bankruptcy.
- You did not file a fraudulent return or evade taxes.
- Your debt is 3 years or older. Newer tax debt may not qualify for bankruptcy.
- You have filed a tax return on time for at least 2 years prior to filing for bankruptcy.
- You pass the "240 day rule" which means the IRS has assessed your income tax debt for at least 240 days prior to filing bankruptcy.
